Tennessee Gang Laws Now Stronger Under RICO Provisions

Effective June 1, 2012, a new law signed by Gov. Haslam, goes into effect.  This new law expands the categories from child pornography and drug trafficking, under the former provisions., to include areas like causing injury or death, receiving money or anything of value from the commission of any aggravated burglary, or from the illegal sale, delivery, or manufacture, of a controlled substance, or firearm.  Under this law, prosecutors have to prove that gang members committed the crimes in the interest of the gang.

In the legislative summary, a conviction under RICO, is a Class 'B' felony with a fine of $ 25,000, and / or between 12 and 20 years in jail.
